Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Messaging data (WhatsApp, Facebook Messenger, SMS)

When a restaurant uses Fonda's messaging tools, we receive and store the content of messages exchanged between the restaurant and the people who contact it, along with the sender's phone number or platform ID, the display name provided by the platform, any photos, documents or voice notes sent, and delivery and read status.

We process this information on the restaurant's behalf, so its staff can answer, assign and keep a record of customer conversations. We do not use message content to advertise to the people who send those messages, we do not sell it, and we do not use it to train machine learning models for third parties.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You may not be able to use some parts of our Service. Unless you have adjusted Your browser setting so that it will refuse Cookies, our Service may use Cookies.
  • Web Beacons. Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).

Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on Your personal computer or mobile device when You go offline, while Session Cookies are deleted as soon as You close Your web browser.

The purpose of these Cookies is to provide You with a more personal experience and to avoid You having to re-enter your preferences every time You use the Website.
  • Analytics and Advertising Cookies and Pixels. Type: Persistent and Session Cookies. Administered by: Third parties. Purpose: These technologies help Us understand how visitors find and use the Website and allow Us to measure and improve Our advertising. They are set or read by the third-party tags described immediately below.

Third-party analytics and advertising technologies

Our Website uses the following third-party tracking technologies. Some of these technologies involve disclosing personal information (such as online identifiers, cookie IDs, IP address, device and browser information, pages viewed, and — where you submit a form — a hashed version of your email address and phone number) to advertising and analytics companies for the purpose of measuring and targeting advertising. Under California law this activity may be considered a "sale" or "sharing" of personal information for cross-context behavioral advertising, and you have the right to opt out (see California Privacy Rights).

  • Meta Pixel and Meta Conversions API (Meta Platforms, Inc.) — used to measure ad performance and build advertising audiences. This includes the _fbp and _fbc cookies, the fbclid click identifier, and server-side transmission of conversion events (including hashed contact details) to Meta. Governed additionally by Meta's Privacy Policy.
  • Google Analytics 4, Google Tag Manager, and Google Ads conversion tracking (Google LLC) — used to measure Website traffic and advertising performance. This includes the _ga cookies and the gclid, gbraid, wbraid and gad_source click identifiers. Governed additionally by Google's Privacy Policy.
  • Campaign attribution storage. We store campaign and click parameters (UTM values and advertising click identifiers) in your browser's local storage so that We can attribute an inquiry to the campaign that brought you to the Website. You can clear this at any time through your browser settings.
  • Scheduling and CRM tools. When you request a demo, We transmit the information you submit (name, email, phone, restaurant name, and campaign attribution) to the scheduling, workflow-automation, e-signature and email providers We use to respond to you and manage the relationship. These providers act as Service Providers and may not use the information for their own purposes.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.
  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
  • For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.
  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
  • To manage Your requests: To attend and manage Your requests to Us.
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

We may share Your personal information in the following situations:

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.
  • Meta Platforms — where messages are sent or received over WhatsApp or Facebook Messenger, that content passes through Meta's systems and is also governed by Meta's own privacy policy.
  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.
  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

Our Service may give You the ability to delete certain information about You from within the Service.

You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section that allows you to manage Your personal information. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.

You have the right to opt out of the sale or sharing of your personal information. Fonda does not sell personal information for money. However, because Our Website uses third-party advertising and analytics technologies (including the Meta Pixel and Google advertising tags), Our disclosure of online identifiers and related activity data to those companies may constitute a "sale" or "sharing" for cross-context behavioral advertising under California law. You can opt out at any time using the methods described in California Privacy Rights.

We do not use or disclose the content of messages exchanged through Our messaging tools for cross-context behavioral advertising, and We do not sell or share that content.

Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

California Privacy Rights (CCPA/CPRA)

This section applies to California residents and supplements the rest of this Privacy Policy. It is provided under the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"). Terms such as "personal information", "sale", "share", "sensitive personal information" and "service provider" have the meanings given to them in that law.

Categories of personal information We collect

In the past twelve months, We have collected the following categories:

  • Identifiers — name, email address, telephone number, business name, IP address, cookie and advertising identifiers.
  • Commercial information — records of services inquired about or purchased, proposals and agreements.
  • Internet or other electronic network activity — pages viewed, referring URL, campaign and click parameters, browser and device information, interactions with Our emails and ads.
  • Geolocation data — approximate location inferred from IP address only.
  • Electronic communications content — the content of messages exchanged through Our messaging tools, processed on behalf of Our restaurant customers.
  • Professional or employment-related information — role at the restaurant or business.
  • Inferences — limited inferences about likely interest in Our services for sales prioritization.

Sensitive personal information

We do not intentionally collect sensitive personal information for the purpose of inferring characteristics about you. The content of communications is treated as sensitive personal information where required; We use it only to perform the Service requested, and We do not use or disclose it for any purpose that would require Us to offer a "Limit the Use of My Sensitive Personal Information" choice. We do not collect Social Security numbers, government identifiers, precise geolocation, biometric data, or information about health, race, religion, sexual orientation or union membership.

Sources, purposes and retention

We collect personal information directly from you (forms, email, phone, messaging), from your device and browser automatically, from Our restaurant customers, and from advertising, analytics, scheduling, e-signature and CRM providers. We use it for the business and commercial purposes described in "Use of Your Personal Data" above. We retain each category only as long as reasonably necessary for those purposes — generally for the duration of the business relationship plus the period required by tax, accounting and legal-recordkeeping obligations, and shorter periods for Usage Data and advertising identifiers.

Disclosure, sale and sharing

In the past twelve months We have disclosed identifiers, commercial information and internet activity information to service providers and contractors (hosting, analytics, email, scheduling, e-signature, CRM and communications providers) for business purposes. We have also disclosed identifiers and internet activity information to advertising partners (Meta and Google) in connection with advertising measurement and audience targeting; that activity may constitute a "sale" or "sharing" for cross-context behavioral advertising. We do not sell or share personal information for monetary consideration, and We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your California rights

  • Right to know the categories and specific pieces of personal information We have collected, the sources, the purposes, and the categories of third parties to whom it was disclosed.
  • Right to delete personal information We collected from you, subject to legal exceptions.
  • Right to correct inaccurate personal information We maintain about you.
  • Right to opt out of sale or sharing of your personal information for cross-context behavioral advertising.
  • Right to limit the use and disclosure of sensitive personal information, where applicable.
  • Right to non-discrimination — We will not deny services, charge different prices, or provide a different level of quality because you exercised a privacy right. We do not offer financial incentives in exchange for personal information.

How to exercise your rights

Email privacy@mifonda.io or support@mifonda.io with the subject line "California Privacy Request", or write to Us at Fonda Technologies Inc, 1250 Borregas Avenue, #174 Sunnyvale, CA 94089. We will acknowledge your request within 10 business days and respond within 45 calendar days, with one extension of up to 45 additional days where reasonably necessary (we will tell you if We need it).

To opt out of the sale or sharing of your personal information, you may: (a) click Your Privacy Choices in the footer of any page of this Website and select "Do not sell or share my info", or email Us at the address above with the subject line "Do Not Sell or Share My Personal Information"; (b) enable a Global Privacy Control (GPC) signal in your browser or extension — We treat a valid GPC signal received from your browser as a request to opt out that browser and device; and/or (c) adjust your browser cookie settings to block third-party cookies, and use Meta's ad settings and Google's ad settings. An opt-out is device- and browser-specific, so you will need to repeat it on each browser and device you use.

Verification. To protect you, We will verify your request by matching the information you provide (such as the email address or phone number you gave Us) against Our records, and We may ask for additional information. We will only use that information to verify your identity.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We will require written permission signed by you and may require you to verify your identity directly with Us.

Shine the Light and Do Not Track

California Civil Code Section 1798.83 permits California residents to request information about the disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes. Some browsers transmit "Do Not Track" signals; because no common standard for responding to them has been adopted, We do not respond to Do Not Track signals, but We do honor Global Privacy Control signals as described above.

Other U.S. State Privacy Rights

If you are a resident of Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana or another state with a comprehensive consumer privacy law, you may have rights to confirm whether We process your personal data, access and obtain a portable copy of it, correct inaccuracies, delete it, and opt out of targeted advertising, the sale of personal data and certain profiling. You may exercise these rights using the contact methods in the California section above, and you may appeal a denial of a request by replying to Our decision with the word "Appeal"; We will respond to an appeal within 45 days.

Marketing, Email and SMS Communications

When you submit a form on Our Website, you consent to be contacted by Fonda by email, phone call and text message about Our services at the contact details you provide. Message frequency varies and message and data rates may apply. You can unsubscribe from marketing email using the link in any email, and stop text messages by replying STOP. We do not share mobile telephone numbers or SMS consent with third parties for their own marketing purposes. Transactional and service-related messages may continue after you opt out of marketing.

Legal Bases for Processing

Where required by law, We rely on the following legal bases: performance of a contract with you; Our legitimate interests in operating, securing, marketing and improving the Service; your consent (which you may withdraw at any time, for example for marketing communications and non-essential cookies); and compliance with Our legal obligations.

Our Role: Controller and Processor

For information We collect about visitors to Our Website and about prospective and current restaurant customers, Fonda acts as the business or controller. For information We process on behalf of a restaurant customer — including customer conversations, orders and contact details handled through Our tools — Fonda acts as a service provider or processor and processes that information only on the restaurant's documented instructions and as permitted by Our agreement with them. If you are a diner or customer of a restaurant that uses Fonda and you wish to exercise privacy rights over that information, please contact the restaurant directly; We will assist them in responding.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.

We will let You know via email and/or a prominent notice on Our Service, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
